ข้อตกลงการใช้บริการฉบับนี้ ("ข้อตกลง") เป็นสัญญาระหว่างท่านกับ Koyun TCG ("แพลตฟอร์ม", "เรา") ซึ่งใช้บังคับกับการเข้าถึงและการใช้งานเว็บไซต์ koyun9.com รวมถึงบริการทั้งหมดที่เกี่ยวข้อง
การสมัครสมาชิก การเปิดร้านค้า หรือการใช้บริการส่วนหนึ่งส่วนใดของแพลตฟอร์ม ถือว่าท่านได้อ่าน เข้าใจ และตกลงผูกพันตามข้อตกลงฉบับนี้ รวมถึงนโยบายความเป็นส่วนตัวซึ่งถือเป็นส่วนหนึ่งของข้อตกลง หากท่านไม่ยอมรับ โปรดยุติการใช้บริการ
แพลตฟอร์มให้บริการพื้นที่ตลาดกลางออนไลน์และเครื่องมือทางเทคนิค เช่น ระบบประกาศขายสินค้า ระบบค้นหา ระบบแชท ระบบคำสั่งซื้อ และระบบรีวิว เพื่ออำนวยความสะดวกให้ผู้ซื้อและร้านค้าติดต่อและทำธุรกรรมระหว่างกัน
เพื่อความชัดเจน แพลตฟอร์ม ไม่ใช่ เจ้าของสินค้า ผู้ขาย ตัวแทนจำหน่าย นายหน้า ผู้ให้บริการรับชำระเงิน (payment service provider) หรือผู้ให้บริการเก็บเงินแทน (escrow) และไม่ใช่คู่สัญญาในสัญญาซื้อขายระหว่างผู้ซื้อกับร้านค้าไม่ว่ากรณีใด
แพลตฟอร์มไม่มีหน้าที่ตรวจสอบความแท้จริง คุณภาพ สภาพ หรือความชอบด้วยกฎหมายของสินค้าทุกรายการล่วงหน้า อย่างไรก็ดี เราสงวนสิทธิ์ในการตรวจสอบ ระงับ หรือลบประกาศที่มีเหตุอันควรเชื่อว่าฝ่าฝืนข้อตกลงหรือกฎหมาย
ผู้สมัครต้องให้ข้อมูลที่ถูกต้อง ครบถ้วน และเป็นปัจจุบัน และอาจต้องยืนยันหมายเลขโทรศัพท์ด้วยรหัส OTP ตามที่แพลตฟอร์มกำหนด
หนึ่งบุคคลพึงมีบัญชีเดียว บัญชีเป็นสิทธิเฉพาะตัว ห้ามโอน ให้ยืม หรือจำหน่ายแก่บุคคลอื่น ท่านมีหน้าที่รักษาความลับของรหัสผ่าน และการกระทำใดๆ ที่เกิดขึ้นผ่านบัญชีของท่านให้ถือว่าเป็นการกระทำของท่าน
ผู้ใช้ต้องมีความสามารถตามกฎหมายในการทำนิติกรรม ผู้เยาว์ต้องได้รับความยินยอมจากผู้แทนโดยชอบธรรมก่อนทำธุรกรรม
ข้อควรทราบสำคัญ: การชำระเงินค่าสินค้าทั้งหมดเกิดขึ้นโดยตรงระหว่างผู้ซื้อกับร้านค้า แพลตฟอร์มไม่รับเงิน ไม่ถือเงิน ไม่ส่งผ่านเงิน และไม่รับประกันการชำระเงินหรือการคืนเงินไม่ว่ากรณีใด เครื่องมือแนบสลิปบนแพลตฟอร์มเป็นเพียงช่องทางส่งหลักฐานให้ร้านค้าตรวจสอบเอง ไม่ถือเป็นการยืนยันหรือรับรองการชำระเงินโดยแพลตฟอร์ม
ผู้ซื้อพึงใช้ความระมัดระวังตามสมควรก่อนโอนเงินทุกครั้ง เช่น ตรวจสอบว่าชื่อบัญชีปลายทางตรงกับข้อมูลร้านค้า และหลีกเลี่ยงการทำธุรกรรมนอกระบบของแพลตฟอร์มซึ่งจะไม่มีหลักฐานในระบบให้ใช้อ้างอิงเมื่อเกิดข้อพิพาท
การสมัครสมาชิกและการใช้งานพื้นฐานไม่มีค่าใช้จ่าย แพลตฟอร์มอาจเสนอบริการเสริมแบบชำระค่าบริการ เช่น แพ็กเกจร้านค้า Premium โดยรายละเอียดและอัตราค่าบริการจะแสดงไว้ ณ จุดสมัครใช้บริการนั้นๆ
ค่าบริการเสริมที่ชำระแล้วไม่สามารถขอคืนได้ เว้นแต่ความบกพร่องเกิดจากระบบของแพลตฟอร์มเอง หรือแพลตฟอร์มพิจารณาคืนให้เป็นรายกรณีตามที่เห็นสมควร
แพลตฟอร์มสงวนสิทธิ์ในการปรับปรุงอัตราค่าบริการ โดยการปรับปรุงจะไม่กระทบสิทธิการใช้บริการที่ชำระเงินไปแล้วในรอบนั้น
เงื่อนไขการจัดส่ง ระยะเวลา ค่าจัดส่ง การรับประกัน การเปลี่ยนหรือคืนสินค้า เป็นข้อตกลงระหว่างผู้ซื้อกับร้านค้าตามนโยบายของแต่ละร้าน ผู้ซื้อพึงสอบถามและตกลงเงื่อนไขให้ชัดเจนผ่านระบบแชทก่อนสั่งซื้อ แพลตฟอร์มไม่มีส่วนเกี่ยวข้องในกระบวนการขนส่งและไม่รับผิดชอบต่อความล่าช้า สูญหาย หรือเสียหายจากการขนส่ง
ข้อพิพาทเกี่ยวกับการซื้อขายถือเป็นเรื่องระหว่างผู้ซื้อกับร้านค้าโดยตรง คู่กรณีพึงเจรจากันโดยสุจริตผ่านระบบแชทของแพลตฟอร์มเป็นลำดับแรก
แพลตฟอร์มอาจเข้าช่วยประสานงาน ตรวจสอบข้อมูลในระบบ หรือไกล่เกลี่ยตามที่เห็นสมควร และอาจใช้มาตรการต่อบัญชีที่มีพฤติกรรมไม่สุจริต เช่น ระงับการมองเห็นร้าน ระงับบัญชีชั่วคราว หรือยุติบัญชีถาวร ทั้งนี้ การเข้าช่วยเหลือดังกล่าวไม่ทำให้แพลตฟอร์มกลายเป็นคู่กรณีหรือผู้รับผิดในข้อพิพาท
กรณีเชื่อว่ามีการกระทำความผิดอาญา เช่น ฉ้อโกง ผู้เสียหายพึงแจ้งความร้องทุกข์ต่อพนักงานสอบสวน แพลตฟอร์มยินดีให้ความร่วมมือส่งมอบข้อมูลที่เกี่ยวข้องตามคำสั่งโดยชอบด้วยกฎหมาย
ท่านยังคงเป็นเจ้าของเนื้อหาที่ท่านอัปโหลด โดยท่านอนุญาตให้แพลตฟอร์มใช้ ทำซ้ำ ดัดแปลงตามสมควร และเผยแพร่เนื้อหาดังกล่าวเท่าที่จำเป็นต่อการให้บริการ เช่น การแสดงประกาศขายและการย่อขนาดรูปภาพ
ท่านรับรองว่าเนื้อหาของท่านไม่ละเมิดสิทธิของบุคคลอื่น ชื่อ เครื่องหมาย โลโก้ และระบบงานของ Koyun TCG เป็นทรัพย์สินของแพลตฟอร์ม ห้ามใช้โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษร
ชื่อการ์ด ภาพการ์ด และเครื่องหมายการค้าของเกมการ์ดต่างๆ เป็นทรัพย์สินของผู้ทรงสิทธิรายนั้นๆ การอ้างถึงบนแพลตฟอร์มเป็นไปเพื่อการระบุตัวสินค้าตามปกติทางการค้าเท่านั้น
แพลตฟอร์มสงวนสิทธิ์ระงับหรือยุติบัญชี ลบประกาศ หรือจำกัดการใช้งานฟีเจอร์ใดๆ หากมีเหตุอันควรเชื่อว่ามีการฝ่าฝืนข้อตกลง กฎหมาย หรือมีพฤติกรรมที่อาจก่อความเสียหายต่อผู้ใช้รายอื่นหรือต่อแพลตฟอร์ม โดยจะแจ้งเหตุแห่งการระงับตามช่องทางที่เหมาะสม เว้นแต่กรณีเร่งด่วนหรือกรณีที่การแจ้งจะกระทบการตรวจสอบ
ท่านสามารถขอยกเลิกบัญชีได้ตลอดเวลาผ่านช่องทางการติดต่อท้ายเอกสารนี้ ทั้งนี้ ภาระผูกพันที่เกิดขึ้นก่อนการยกเลิก เช่น คำสั่งซื้อที่ยังไม่เสร็จสิ้น ยังคงต้องดำเนินการให้แล้วเสร็จ
แพลตฟอร์มให้บริการ "ตามสภาพที่เป็นอยู่" (as is) และ "ตามที่มีให้บริการ" (as available) เราไม่รับรองว่าบริการจะปราศจากข้อผิดพลาด ต่อเนื่อง หรือปลอดภัยโดยสมบูรณ์ตลอดเวลา
ภายในขอบเขตสูงสุดที่กฎหมายอนุญาต แพลตฟอร์มไม่รับผิดต่อความเสียหายทางตรง ทางอ้อม ค่าเสียโอกาส หรือความเสียหายต่อเนื่องใดๆ ที่เกิดจากหรือเกี่ยวเนื่องกับ: (ก) การกระทำหรือละเว้นการกระทำของผู้ซื้อหรือร้านค้า (ข) คุณภาพ ความแท้จริง หรือความถูกต้องของสินค้าและประกาศ (ค) การชำระเงิน สลิปปลอม หรือการไม่ได้รับสินค้า (ง) การหยุดชะงักหรือข้อผิดพลาดของระบบ และ (จ) เหตุการณ์ที่อยู่นอกเหนือการควบคุมตามสมควรของแพลตฟอร์ม
หากศาลมีคำวินิจฉัยให้แพลตฟอร์มต้องรับผิดไม่ว่ากรณีใด ความรับผิดรวมสูงสุดของแพลตฟอร์มจะไม่เกินจำนวนค่าบริการที่ผู้ใช้รายนั้นได้ชำระให้แก่แพลตฟอร์มในรอบ 12 เดือนก่อนเกิดเหตุ
ท่านตกลงปกป้องและชดใช้ค่าเสียหายแก่แพลตฟอร์มจากข้อเรียกร้องของบุคคลภายนอกอันเกิดจากการที่ท่านฝ่าฝืนข้อตกลงฉบับนี้ ฝ่าฝืนกฎหมาย หรือละเมิดสิทธิของบุคคลอื่นผ่านการใช้บริการของท่าน
แพลตฟอร์มไม่ต้องรับผิดต่อความล่าช้าหรือการไม่สามารถให้บริการอันเนื่องมาจากเหตุสุดวิสัยหรือเหตุการณ์ที่อยู่นอกเหนือการควบคุมตามสมควร เช่น ภัยธรรมชาติ การขัดข้องของผู้ให้บริการโครงสร้างพื้นฐาน การโจมตีทางไซเบอร์ หรือการเปลี่ยนแปลงกฎหมายและคำสั่งของหน่วยงานรัฐ
หากข้อกำหนดใดของข้อตกลงฉบับนี้ตกเป็นโมฆะหรือใช้บังคับไม่ได้ ให้ข้อกำหนดส่วนที่เหลือยังคงมีผลบังคับต่อไป การที่แพลตฟอร์มไม่ใช้สิทธิตามข้อตกลงในคราวใด ไม่ถือเป็นการสละสิทธินั้นในคราวถัดไป
ข้อตกลงฉบับนี้อยู่ภายใต้บังคับและการตีความตามกฎหมายแห่งราชอาณาจักรไทย ข้อพิพาทที่เกี่ยวเนื่องกับข้อตกลงนี้ให้อยู่ในเขตอำนาจของศาลไทย
แพลตฟอร์มอาจแก้ไขปรับปรุงข้อตกลงฉบับนี้เป็นครั้งคราว โดยจะระบุวันที่มีผลบังคับใช้ของฉบับล่าสุดไว้ที่ส่วนหัวของเอกสาร กรณีการแก้ไขมีนัยสำคัญจะประกาศให้ทราบล่วงหน้าตามสมควร การใช้บริการต่อไปภายหลังวันที่มีผลบังคับใช้ถือว่าท่านยอมรับข้อตกลงฉบับที่แก้ไขแล้ว

These Terms of Service (the "Terms") constitute an agreement between you and Koyun TCG (the "Platform", "we", "us") governing your access to and use of koyun9.com and all related services.
By registering an account, opening a shop, or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which forms part of these Terms. If you do not agree, please discontinue use of the service.
The Platform provides an online marketplace and technical tools — including product listings, search, in-app chat, order management, and reviews — to facilitate contact and transactions between buyers and sellers.
For the avoidance of doubt, the Platform is not the owner of the items, a seller, a distributor, a broker, a payment service provider, or an escrow agent, and is under no circumstances a party to any sale contract between a buyer and a seller.
The Platform has no obligation to pre-screen the authenticity, quality, condition, or legality of every listing. We nevertheless reserve the right to review, suspend, or remove any listing that we reasonably believe violates these Terms or applicable law.
Applicants must provide accurate, complete, and current information, and may be required to verify their telephone number via a one-time password (OTP).
Each person should maintain a single account. Accounts are personal and may not be transferred, lent, or sold. You are responsible for keeping your password confidential; all activity occurring under your account is deemed to be yours.
Users must have legal capacity to enter into transactions. Minors must obtain the consent of their legal representative before transacting.
Important: all payments for goods are made directly between buyer and seller. The Platform does not receive, hold, or transmit funds, and does not guarantee any payment or refund under any circumstances. The slip-attachment feature is merely a channel for delivering evidence to the seller for the seller's own verification; it does not constitute confirmation or endorsement of payment by the Platform.
Buyers should exercise reasonable caution before every transfer — for example, confirming that the receiving account name matches the seller's details — and should avoid transacting outside the Platform, where no in-system evidence will exist should a dispute arise.
Registration and basic use of the Platform are free of charge. The Platform may offer Paid Services, such as the Premium shop package; details and rates are displayed at the point of subscription.
Fees paid for Paid Services are non-refundable, except where the failure is attributable to the Platform's own systems or where the Platform decides to grant a refund on a case-by-case basis.
The Platform reserves the right to revise its fees; revisions will not affect services already paid for in the current billing period.
Shipping terms, timelines, costs, warranties, exchanges, and returns are matters agreed between buyer and seller under each shop's policy. Buyers should clarify these terms via chat before ordering. The Platform is not involved in the logistics process and is not liable for delay, loss, or damage in transit.
Disputes concerning a sale are matters directly between buyer and seller, who should first negotiate in good faith through the Platform's chat system.
The Platform may, at its discretion, assist with coordination, review in-system records, or mediate, and may take measures against accounts engaging in bad-faith conduct — including delisting a shop, temporary suspension, or permanent termination. Such assistance does not make the Platform a party to, or liable in, the dispute.
Where a criminal offence such as fraud is suspected, the injured party should file a complaint with the police. The Platform will cooperate and provide relevant records pursuant to lawful orders.
You retain ownership of the content you upload. You grant the Platform a licence to use, reproduce, reasonably adapt, and display such content to the extent necessary to operate the service — for example, displaying listings and resizing images.
You warrant that your content does not infringe the rights of any third party. The Koyun TCG name, marks, logo, and systems are the property of the Platform and may not be used without prior written permission.
Card names, artwork, and trademarks of the respective card games belong to their rights holders; references on the Platform are made solely for the ordinary commercial purpose of identifying the items.
The Platform reserves the right to suspend or terminate accounts, remove listings, or restrict features where it reasonably believes these Terms or the law have been violated, or where conduct may harm other users or the Platform. Reasons will be communicated through appropriate channels, save in urgent cases or where notice would prejudice an investigation.
You may close your account at any time via the contact channels at the end of this document. Obligations arising before closure — such as unfinished orders — must still be completed.
The service is provided "as is" and "as available". We do not warrant that the service will be error-free, uninterrupted, or completely secure at all times.
To the maximum extent permitted by law, the Platform shall not be liable for any direct, indirect, incidental, or consequential loss arising out of or in connection with: (a) acts or omissions of buyers or sellers; (b) the quality, authenticity, or accuracy of items or listings; (c) payments, forged slips, or non-delivery of items; (d) interruption or malfunction of the service; and (e) events beyond the Platform's reasonable control.
Should the Platform nevertheless be held liable, its aggregate liability shall not exceed the total fees paid by the affected user to the Platform in the 12 months preceding the event.
You agree to defend and indemnify the Platform against third-party claims arising from your breach of these Terms, your violation of law, or your infringement of the rights of others through your use of the service.
The Platform shall not be liable for delay or failure to provide the service due to force majeure or events beyond its reasonable control, including natural disasters, failures of infrastructure providers, cyber-attacks, or changes in law or governmental orders.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force. The Platform's failure to enforce any right on one occasion shall not constitute a waiver of that right on any other occasion.
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Disputes arising in connection with these Terms are subject to the jurisdiction of the Thai courts.
The Platform may amend these Terms from time to time. The effective date of the current version is stated at the top of this document. Material changes will be announced with reasonable advance notice. Continued use of the service after the effective date constitutes acceptance of the amended Terms.
